欢迎您使用Pokca软件！北京一个念头科技有限公司（以下简称"我方"或"一个念头"）非常重视用户的隐私和个人信息保护。您在使用我方的产品与/或服务时，我方可能会收集和使用您的相关信息。我方希望通过Pokca隐私条款（以下简称"本条款"或"本协议"）向您说明我方在您使用我方的产品与/或服务时如何收集、使用、保存、共享和转让这些信息。请您务必审慎阅读、充分理解各条款内容。

除非您完全接受本协议的全部内容，否则您无权下载、安装、注册、登录、使用（以下统称"使用"）Pokca软件。若您使用Pokca软件及相关服务，即视为您已阅读并同意本协议的约束，包括我方对本协议随时所做的、在法律允许的最大范围内的任何修改。

如果您未满18周岁，请在法定监护人的陪同下阅读本协议并充分理解本协议，并征得法定监护人的同意后使用Pokca软件及相关服务。

  1. 我方如何收集和使用信息

    • 您提供的信息：您注册账户时或使用我方的服务时，向我方提供的手机号码、用户名、密码。如您通过在第三方网络平台（包括但不限于Facebook、Twitter、微信、微博、QQ等）的账户注册或使用我方的服务的，您授权我方获取的您向该等第三方网络平台提供的相关信息，包括但不限于您的头像、用户名、个人信息、好友关系、您通过第三方网络平台共享的内容等。
    • 您通过"投稿"功能或相关服务发布的用户内容：包括但不限于图片、文字及元数据，或其他相关材料。用于"投稿"功能或相关服务的实现，与产品改进。
    • 设备信息：我方会根据您在Pokca软件使用中授予的具体权限，接收并记录您所使用的设备相关信息（例如设备型号、操作系统版本、唯一设备标识符、IP地址、GPS位置信息、软件版本号等软硬件特征信息），用于常规功能的实现、统计使用Pokca软件及相关服务的设备数量并进行设备机型数据分析与图形适配分析，和购买、优惠、折扣和其他活动的防作弊处理。
    • Cookie 和类似技术：我方或我方的第三方合作伙伴可能通过Cookie或同类技术收集有关您如何使用及为您提供功能的信息。我方可能要求广告商或其他合作伙伴向您的设备投放广告或提供服务，这可能要使用我方或第三方放置的 Cookie 或类似技术。
    • 日志文件信息：我方会收集您对Pokca软件及相关服务的详细使用情况，作为有关日志保存，包括接入网络的方式、类型和状态、网络质量数据、操作日志、服务日志信息。用于处理、维护、改善、开发Pokca软件及相关服务，和以改进产品为目的的数据分析。
    • 元数据：元数据通常是与用户内容相关联的技术数据。当您在使用我方的服务时，我方将利用元数据为您提供体验更好的服务或功能。正常情况下，这些元数据无法用于识别任何特定的个人。这些元数据是为了改进服务目的，并非用于识别任何特定的个人。

  2. 我方如何共享、转让、公开披露您的个人信息

    • 除以下情形外，未经您同意，我方不会与北京一个念头科技有限公司及关联企业之外的任何主体分享您的信息：

      • 维护和改善我方的服务。我方可能向合作伙伴及其他第三方分享您的信息，以帮助我方为您提供更有针对性、更完善的服务。
      • 实现本协议中《我方如何收集和使用信息》部分所述目的。
      • 履行我方在本协议或我方与您达成的其他协议中的义务和行使我方的权利。
      • 向委托我方进行推广的合作伙伴等第三方共享，目的是为了使该等委托方了解推广的覆盖面和有效性（仅提供无法识别个人身份的统计信息）。
      • 应您合法需求，协助处理您与他人的纠纷或争议。
      • 应您的监护人合法要求而提供您的信息。
      • 根据与您签署的单项服务协议或其他的法律文件约定所提供。

  3. 例外

    • 以下情形中，分享、转让、披露您的信息无需事先征得您的授权同意：
      • 与国家安全、国防安全有关的；
      • 与公共安全、公共卫生、重大公共利益有关的；
      • 与犯罪侦查、起诉、审判和判决执行等司法或行政执法有关的；
      • 出于维护您或其他个人的生命、财产等重大合法权益但又很难得到本人同意的；
      • 您自行向社会公众公开的信息；
      • 从合法公开披露的信息中收集信息的，如合法的新闻报道、政府信息公开等渠道。

  4. 其他

    • 根据法律规定，共享、转让经去标识化处理的信息，且确保数据接收方无法复原并重新识别信息主体的，不属于信息的对外共享、转让及公开披露行为，对此类数据的保存及处理将无需另行向您通知并征得您的同意。
    • 未成年人信息保护：如您为未成年人的，建议您请您的父母或法定监护人仔细阅读本隐私权政策，并在征得您的父母或监护人同意的前提下使用我方的服务或向我方提供信息。对于经父母或监护人同意使用我方的产品或服务而收集未成年人个人信息的情况，我方只会在法律法规允许，父母或监护人明确同意或者保护未成年人所必要的情况下使用，共享，转让或披露此信息。

    • 本协议的成立、生效、履行、解释及争议的解决均应适用中华人民共和国大陆地区法律。如果本协议中某项条款因与中华人民共和国大陆地区现行法律相抵触而导致无效，将不影响其他部分的效力。在法律允许的最大范围内，北京一个念头科技有限公司拥有对本协议的解释、修改、更新权。

("we," "us," or "our") collects, uses, and shares your personal information when you use our Pokca software and related services (the "Services").
