欢迎您使用Pokca软件！为使用Pokca软件（以下简称"我方"或"Pokca"）提供的服务，您应当阅读并遵守《Pokca用户协议》（以下简称"本协议"）。请您务必审慎阅读、充分理解各条款内容，特别是免除或者限制责任的条款、管辖与法律适用条款。

除非您完全接受本协议的全部内容，否则您无权下载、安装、注册、登录、使用（以下统称"使用"）Pokca软件。若您使用Pokca软件及相关服务，即视为您已阅读并同意上述协议的约束，包括北京一个念头科技有限公司对本协议随时所做的、在法律允许的最大范围内的任何修改。

如果您未满18周岁，请在法定监护人的陪同下阅读本协议并充分理解本协议，并征得法定监护人的同意后使用Pokca软件及相关服务。

  1. 本协议的范围

    • 本协议是您与北京一个念头科技有限公司（以下简称"我方"或"一个念头"）之间就您注册、登录、使用Pokca软件，并获得Pokca软件提供的相关服务所订立的协议。
    • 北京一个念头科技有限公司可能根据自身对商业、法律与政策等要素的判断，随时更新本协议；若您无法接受本协议未来更新版本的全部或者部分条款，可联系我方,在您未与我方沟通一致前,请停止使用Pokca。

  2. 使用Pokca软件及相关服务

    • 您可以通过使用Pokca软件获取拍照、图片处理等服务。
    • 您理解，您使用Pokca软件及相关服务须自行配备与软件和相关服务有关的设备及服务（如计算机、移动通信设备、网络等），并自行支付与上述设备及服务有关的费用。

  3. 遵守法律

    • 您同意遵守中华人民共和国相关法律法规的所有规定，并对以任何方式使用您的密码、帐号及设备使用Pokca的任何行为及其结果承担全部责任。如您的行为违反国家法律和法规的任何规定，有可能构成犯罪的，将被追究刑事责任，并由您承担全部法律责任。
    • 在任何情况下，如果我方有合理理由认为，包括但不限于您的任何言论和其它行为违反或可能违反国家法律和法规的任何规定，我方可在任何时候不经事先通知终止向您提供服务。

  4. 用户行为规范

    • 您应对您使用Pokca软件及相关服务的行为负责，除非法律允许或者经我方事先书面许可，您使用Pokca软件及相关服务不得具有下列行为：
      • 不得发布、传送、传播、储存危害国家安全统一、破坏社会稳定、违反公序良俗、侮辱、诽谤、淫秽、暴力以及任何违反国家法律法规的内容；
      • 不得发布、传送、传播、储存侵害他人知识产权、商业秘密等合法权利的内容；
      • 不得通过Pokca软件及相关服务发布暴力、裸露、部分裸露、歧视、违法、侵权、恶心、色情或包含性暗示的图片或其他内容；
      • 不得将Pokca软件及相关服务用于非法或无授权的途径；
      • 禁止诽谤、胁迫、欺辱、辱骂、骚扰、威胁、假冒或恐吓他人或其他实体，禁止利用Pokca软件及相关服务发布隐私或机密信息，包括但不限于您自己或他人的身份证号、银行卡号、护照号、家庭住址、非公共电话号码或非公共电子邮箱等；
      • 您不得对Pokca软件及相关服务（包括但不限于内容或产品中的广告或赞助内容）进行任何形式的许可、出售、租赁、转让、发行或做其他商业用途；未经我方书面同意，您不得有偿或者无偿转让依本协议条款所取得的用户权利。
      • 您不得以创建相同或竞争服务为目的使用本软件及相关服务；
      • 除非法律明文规定，否则您不得对Pokca软件及相关服务（包括但不限于内容或产品中的广告或赞助内容）的任何部分以任何形式或方法进行复制、发行、再版、下载、显示、张贴、修改、翻译、合并、利用、分解或反向编译等；
      • 您已同意不在Pokca软件及相关服务中从事下列行为：上传或发布病毒、蠕虫、恶意代码、故意破坏或改变计算机系统或数据的软件；未授权的情况下，收集其他用户的信息或数据，例如电子邮箱地址等；干扰或损害本网站服务器和网络链接。
      • 禁止尝试限制其他用户使用或享受Pokca软件及相关服务，禁止鼓励或助长违反本协议的行为；以及其他法律法规明确禁止的行为。
    • 您对自己的行为以及您通过Pokca软件及相关服务主动上传、提交、发布或显示的任何数据、文字、文件、信息、账号、图像、图形、照片、个人档案、音频、视频片段、声音、音乐作品、原创作品、应用程序、链接和其他内容或材料负有完全责任。
    • 若我方认定用户有违反本协议的行为，可能会终止对其的服务。您理解并同意，北京一个念头科技有限公司不能也不会为Pokca软件及相关服务上发布的用户内容负责，您使用Pokca软件及相关服务需自担风险。若您违反本协议的规定或其精神，或以其它方式导致我方承担风险或可能承担法律责任，我方将全部或部分停止向您提供Pokca软件及相关服务。

  5. 广告

    • Pokca软件及相关服务中可能包括广告，这属于北京一个念头科技有限公司及其关联公司合理合法的商业模式，您同意在使用Pokca软件及相关服务过程中接收由北京一个念头科技有限公司及其关联公司或者其第三方合作伙伴发布的广告信息。
    • 北京一个念头科技有限公司依照法律规定履行广告及推广相关义务，您应当自行判断该广告或推广信息的真实性和可靠性并为自己的判断行为负责。除法律法规明确规定外，您因该广告或推广信息进行的购买、交易或因前述内容遭受的损害或损失，您应自行承担，北京一个念头科技有限公司不予承担责任。

  6. 知识产权

    • Pokca软件及相关服务本身自带的程序代码、界面设计、版面框架、数据资料、账号、图片、图形、图表和所有的信息内容的知识产权均归北京一个念头科技有限公司、关联公司或我方的合作伙伴所有，除按照法律法规规定应由相关权利人享有权利的内容以外。
    • 您在Pokca软件及相关服务设计、发布、收集问卷时，您应该保证您为著作权人或已取得合法授权，并且该内容不会侵犯任何第三方的合法权益。您同意授权北京一个念头科技有限公司、关联公司或我方的合作伙伴所有上述内容在全球范围内的免费、非独家、不可撤销的、永久的、可再许可或转让的使用权许可（包括但不限于复制权、翻译权、汇编权、信息网络传播权、改编权、制作衍生品等）。北京一个念头科技有限公司将尽最大努力在合理范围内使用上述内容，且您的必要授权并不代表北京一个念头科技有限公司对上述信息内容的必然使用，也不改变上述信息内容的所有权及其知识产权归属，更不影响您对上述内容信息任何合法使用。

    • 您理解并同意，Pokca软件及相关服务可能会受多种因素的影响或干扰，我方不保证(包括但不限于)：
      • Pokca软件及相关服务完全适合您的的使用要求；
      • Pokca软件及相关服务不受干扰，及时、安全、可靠或不出现错误；
      • Pokca软件及相关服务中任何错误都将能得到更正；
      • 您经由Pokca软件及相关服务购买或取得之任何产品、服务、资讯或其它信息将符合您的期望；
      • Pokca软件及相关服务在使用中会受到包括但不限于如下不可抗力或者其他因素的影响：政治原因、社会环境、自然灾害、经济危机、计算机病毒或黑客攻击、服务器或系统不稳定、您所在的特殊位置、任何技术能力、网络质量以及通信线路、计算机故障等（以下统称"免责事由"）。若出现上述免责事由情况时，我方将尽努力在第一时间及时修复，但因不可抗力给您造成了损失，您同意我方不承担责任。

  9. 服务变更、中断与终止

    • 除本协议其他约定外，北京一个念头科技有限公司及其关联公司还有权根据根据自身对商业、法律与政策等要素的判断，对Pokca服务进行变更、中断或终止。除其他协议另有规定外，我方不对相应变更、中断或终止承担任何责任。

  10. 法律适用及管辖

    • 本协议的成立、生效、履行、解释及争议的解决均应适用中华人民共和国大陆地区法律。如果本协议中某项条款因与中华人民共和国大陆地区现行法律相抵触而导致无效，将不影响其他部分的效力。
    • 在法律允许的最大范围内，北京一个念头科技有限公司拥有对本协议的解释、修改、更新权。

IMPORTANT NOTICE: THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER. IT AFFECTS YOUR LEGAL RIGHTS AS DETAILED IN THE ARBITRATION AND CLASS ACTION WAIVER SECTION BELOW. PLEASE READ CAREFULLY.

PLEASE READ THESE TERMS OF SERVICE CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS. THESE INCLUDE VARIOUS LIMITATIONS AND EXCLUSIONS, AND A CLAUSE THAT GOVERNS THE JURISDICTION AND VENUE OF DISPUTES.

DEFINITIONS

"Services" refers to the Pokca mobile application, website, and all related services provided by Beijing Yige Niantou Technology Co., Ltd.

"Company," "we," "us," or "our" refers to Beijing Yige Niantou Technology Co., Ltd.

"You" or "your" refers to the individual or entity using our Services.

"User Content" refers to any content that users submit, upload, or transmit through our Services.

1. ACCEPTANCE OF TERMS

1.1. These Terms govern your access to and use of our Services.

1.2. By accessing or using the Services, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (available at Privacy Policy), which is incorporated herein by reference.

1.3. ELIGIBILITY. You must be at least 18 years old to use the Services. If you are under 18, you may only use the Services with the involvement of a parent or legal guardian who agrees to be bound by these Terms.

2. CHANGES TO TERMS

2.1. We may modify these Terms at any time in our sole discretion.

2.2. We will notify you of any material changes by posting the new Terms at this location and updating the "Last Updated" date above.

2.3. Your continued use of the Services following such notification constitutes your acceptance of the modified Terms.

3. ACCOUNT REGISTRATION

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Services and for any activities or actions under your account. You agree not to disclose your password to any third party.

4. USER CONTENT

You may submit sample photos to us through our submission feature ("User Content"). You are solely responsible for any User Content you submit, including its legality, reliability, and appropriateness. We reserve the right to review, screen, and monitor any User Content submitted.

By posting User Content to the Services, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such User Content in any and all media or distribution methods (now known or later developed).

5. PROHIBITED USES

You agree not to use the Services:

  • In any way that violates any applicable federal, state, local, or international law or regulation
  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation
  • To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which may harm us or users of the Services
  • To upload or transmit any content that:
    • Is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable
    • Infringes any patent, trademark, trade secret, copyright, or other intellectual property rights of any party
    • Contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware

6. INTELLECTUAL PROPERTY

The Services and their original content (excluding User Content), features, and functionality are and will remain the exclusive property of Beijing Yige Niantou Technology Co., Ltd. and its licensors. The Services are protected by copyright, trademark, and other laws of both China and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

7. TERMINATION

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Services will immediately cease.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BEIJING YIGE NIANTOU TECHNOLOGY CO., LTD., ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY:

(a) INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES;

(b) LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES;

(c) DAMAGES RELATING TO YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICES;

(d) DAMAGES RELATING TO ANY CONDUCT OR CONTENT OF ANY THIRD PARTY USING THE SERVICES;

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

9. DISCLAIMER

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE SERVICES ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR COURSE OF PERFORMANCE.

10. GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of the People's Republic of China. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

11. SEVERABILITY

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12. CHANGES TO SERVICE

We reserve the right to withdraw or amend our Services, and any service or material we provide via the Services, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Services is unavailable at any time or for any period.

14. ARBITRATION AND CLASS ACTION WAIVER

14.1. Agreement to Arbitrate. You and Company agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof or the use of the Services (collectively, "Disputes") will be settled by binding arbitration, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

14.2. Class Action Waiver. YOU AND COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

15. EXPORT CONTROL

The Services may be subject to export control laws. You agree to comply with all applicable export and re-export control laws and regulations.

16. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Company regarding the use of the Services, superseding any prior agreements between you and Company relating to your use of the Services.
